The date of performance is the date on which both parties sign the contract. It is that both parties accept the general conditions of sale, as described in the contract. This depends on the intention of the parties and the date on which the other elements of the conclusion of a contract were fulfilled (these are the offer, acceptance, consideration, intention to create legal relationships and certainty of conditions). The entry into force or validity clause of the Agreement shall fix the date of entry into force of the rights and obligations arising from the Agreement. The date of entry into force shall not be the same as the date of execution. In the absence of a date of entry into force, the terms of the implementing agreement shall take effect. This language makes anyone who reads the written contract understand that they have been demoted. It also explains why the contract is demoted.
